1) Both men were not able to attend the trial for the simple reason that the government of Canada ordered them deported for life in April 2008 and declared them inadmissible. They are not legally allowed to enter Canada, and thus they are being forced by this deportation order to not be present in the court.
On the issue of their deportation. A simple application to Immigration explaining that you had been deported and need a temporary permit so you can attend your trial.
2)The DFO seized the Sea Shepherd Conservation Society's ship, the Farley Mowat, without an arrest order. The ship was then ordered confiscated and sold at auction without a hearing or even a summons or a request to the owners to appear. The ship was stolen without due process of law and forfeited without charges before the two defendants were scheduled to appear in court.
Paul Watson could have go his ship back anytime he wanted by filling out the paperwork and filing it with the courts. Efforts were made to contact him but he was just to arrogant to respond.
3) Paul Watson claimed that his ship was in international waters and Canadian laws did not apply.
The anti-sealing ship had spent most of that day engaged in a cat-and-mouse game with the coast guard and two sealing vessels hunting in the ice-caked waters about 60 kilometers off Cape Breton Island. 4) Paul Watson stated on Tuesday, April 15, 2008 -"I have never been convicted of any felony'
"For his crimes against both people and property, Paul Watson has spent much time in the jails, and before the judges, of numerous countries, from Canada to Costa Rica. In 1997, he was imprisoned in a maximum-security facility in the Netherlands, where he was picked up for the scuttling of a whaling ship at dock, and the intentional ramming of a Norwegian coast guard vessel. Most recently, Watson was investigated by a Costa Rican court for the attempted murder of a local fisherman. In 2002, when he came across a shark fisherman in a 13-foot vessel, Watson attempted to ram the fisherman's boat with his SSCS mammoth flagship
In a recent interview, when asked if he viewed violence as a "legitimate means of social change," Watson replied, "We are a violent species, and we always solve our problems with violence. There have been no exceptions. Nonviolent victories are a myth. Force has always prevailed…One person's terrorist is another person's freedom fighter."
